What Is Insolvency Receivables Management?

Insolvency receivables management is the servicing, collection and sale of accounts receivable that belong to a bankrupt or insolvent company’s estate. When a business enters bankruptcy, receivership, a CCAA proceeding or Chapter 11, its unpaid customer invoices, loans, leases and judgments become estate assets. The trustee, receiver or monitor must turn them into cash for creditors, usually with a reduced or departed finance team. Cedar Financial does that work: we verify balances, run billing and collections in the estate’s name or as a collection agency, recover delinquent and cross-border accounts, and buy receivables portfolios when a sale serves the estate better.

The Roadblocks Estates Face

Receivables lose value every week they sit. These are the situations we’re called in for most often.

1

The finance team is gone

Invoices still need to go out and payments still need to be applied, with no one left to do it.

2

Records you can't rely on

Aging reports that don’t match reality, disputed balances and debtors that can’t be confirmed.

3

Accounts left after the sale

Excluded receivables, post-closing collections and working-capital adjustments still to settle.

4

Debtors across borders

Customers in other provinces, states or countries, with different laws, languages and time zones.

Service First. Buy If Needed.

One partner, two exits for the estate. We start by recovering at full value, and stand ready to purchase when certainty matters more.

Frequently Asked Questions

They become assets of the estate, controlled by the receiver, trustee or monitor. The court officer collects them, sells them, or does both, and the proceeds are distributed to creditors. Because receivables lose value quickly once a business fails, most court officers act on them early, often with an outside servicer such as Cedar Financial.

Yes. Receivers, trustees and monitors routinely retain collection agents and servicers to recover estate receivables, typically under the powers in their appointment order or with court approval where it is required. Cedar works under an engagement letter with the court officer and reports in a form suitable for the court.

The Chapter 7 trustee. The debtor’s receivables are property of the estate, and the trustee is responsible for collecting them, often by retaining a collection agency or servicer with court approval. Cedar supports Chapter 7 and Chapter 11 trustees, liquidating trusts and their counsel.

Most engagements are contingency-based, so the estate pays only on what we recover. Rates depend on whether we service first-party or third-party, commercial or consumer debt, the age and stage of the accounts, balance sizes, and where debtors are located. We provide a proposal specific to each matter after reviewing the receivables.
